Si le timaron con el apartamento de la playa, reclame

¿Le prometieron aire acondicionado y se lo encontró roto o no había? ¿Le dijeron que disfrutaría de una espaciosa terraza y sólo era un balcón con vistas al vecino? Ante la tentación de olvidar lo ocurrido, el colectivo de consumidores Facua-Consumidores en Acción insta a quienes a que realicen las reclamaciones necesarias ante posibles irregularidades en la contratación de las vacaciones, especialmente en el caso de los apartamentos.

Rocío Algeciras, miembro del gabinete jurídico de la asociación, aseguró que tras las vacaciones aumentan las reclamaciones por “la pérdida de maletas durante un vuelo o la cancelación del mismo, pero también porque el apartamento alquilado en la playa dista mucho de la realidad”.

De este modo, señaló que si el alquiler de una vivienda durante el verano se realiza a través de una agencia inmobiliaria “lo normal es que haya un inventario de los bienes de la casa y que se establezcan una serie de requisitos, como el precio o la fecha de entrada y salida, que se deben respetar”.

Los mayores problemas se producen con apartamentos alquilados sin intermediario y vía Internet

El problema, dijo, existe en los apartamentos que se arriendan “directamente entre particulares”, ya que “en la mayoría de los casos ni siquiera existe un papel ni media ningún contrato” por lo que “es más difícil realizar reclamaciones”. “Muchas veces los problemas vienen con los alquileres a través de Internet, porque la foto dista mucho de la realidad”, aseveró.

Conservar la documentación

La OCU aconseja, por ejemplo, que si tuvo que abandonar el apartamento porque éste no se encontraba en codiciones de ser habitado, “conserve los justificantes de gastos que le haya ocasionado volver a alojarse”.

Desde Facua la recomendación es similar, para el trámite de cualquier reclamación es preciso “conservar cualquier tipo de documentación”, ya sea la hoja de reclamación que se haya puesto a la compañía aérea o el folleto publicitario que “son parte del contrato y serán muy importantes a la hora de la reclamación”.

En ningún caso, las asociaciones recomiendan a los usuarios que se encuentren con estos problemas “aguantarse y querer olvidar las vacaciones porque han costado mucho dinero y tiempo, y están muy lejos las próximas”.

Fianzas, roturas y desperfectos

Entre las recomendaciones de la OCU, destaca, por ejemplo, que sólo es lícito cobrar una fianza cuando se ha reservado un apartamento si así estaba previsto en las cláusulas del contrato o en las condiciones generales de la contratación. En la Comunidad Valenciana, por ejemplo, la fianza de los apartamentos turísticos no puede exceder de 150,25 euros.

Por otro lado, el servicio de limpieza de los apartamentos “no es uno de los conceptos incluidos necesariamente en el precio global”, señala el manual de la OCU, por lo que el inquilino debe negarse a pagar los gastos generados por la limpieza.

¿Qué sucede si, durante la estancia, se ha roto la cocina? Según la OCU, el usuario tiene derecho a que le indemnicen por el perjuicio que le pudiera causar esta avería: “puede, por ejemplo, pedir que le reembolsen los gastos de restaurante ya que no le fue posible utilizar la cocina. En este caso, no incurra en gastos exagerados”, recomienda.

Jazz on New Years Day

On the first of January 2009 hundreds of people of all nationalities gathered on the beach in La Marina. They set up barbecues, brought cool boxes full of refreshments and enjoyed some open air jazz music. For the 5th year running Plan B and All That Jazz gave a concert in order to support the Butterfly Children. The concert started at 13.00h and finished around 15.00h. It was a great way to start the new year.

Boxing Day in Guardamar

Guardamar is obviously a great place to visit in summer to enjoy its beaches. It is also a great winter excursion because of its extensive park areas, thats why I went there on boxing day. Especially if you have children you should visit the Parque Reina Sofia. It is full of ducks, swans and peacocks that roam freely. Additionally there is a huge play area with swings and slides for the little ones. From there I went to the beach. There were a few brave people swimming. From there I found my way to the larger park of Alfonso XIII, which is a natural park, formed as a result of the planting of pines in the early 20th century. The resulting pine forest protects Guardamar from winds and moving sand and provides it with excellent natural recreation areas. The mountain engineer Francisco Mira y Botella came up with that idea and has a very nice little statue in his honour at the entance of the park.
